It is an alarming lesson in political hypocrisy, the erosion of democratic credibility, and the question of why different rules seem to apply to the country's elites than to the rest of society.

A child, a scandal, and the question of what is acceptable

When Jens Spahn, the leader of the CDU/CSU parliamentary group, and his husband Daniel Funke announced the birth of their son Georg in July 2026, the initial public reaction was one of congratulations for a rainbow family. Within hours, however, the mood shifted when it became known that the child had been carried by a surrogate mother in the USA. The Green Party health policy expert Janosch Dahmen summed it up perfectly when he criticized the fact that anyone who politically promotes rules should clearly explain why they obviously don't apply to them. This form of double standard is so explosive because it does not remain abstract, but becomes visible in a concrete, media-marketed individual case.

One party in a state of awkward silence

The reaction of his own party is striking. While the Greens, the Left Party, and the FDP immediately pointed out the contradiction, the CDU/CSU remained largely silent. Isolated voices, such as the Thuringian Women's Union chairwoman Marion Rosin and the senior citizens' representative Hubert Hüppe, reiterated their fundamental criticism of the practice of surrogacy, but avoided a direct, personalized confrontation with the case of their own parliamentary group leader. Furthermore, a confidential report is said to suggest that Spahn may have given preferential treatment to a company with close ties to his political party in the allocation of masks in 2020. The firewall as a rhetorical shield

The contrast between Spahn's public role as a supposed defender of the democratic center and his private connections to a milieu that openly sympathizes with anti-democratic positions is remarkable. Spahn has repeatedly and publicly affirmed the so-called firewall against the AfD, describing it as a Putin-loyal party that tolerates anti-Semites and right-wing extremists in its ranks. This resilience is not based on substantive persuasiveness, but rather on the structural ability to absorb scandals without any institutional consequences arising. Societal polarization as collateral damage

Another aspect often overlooked in public debate is the polarizing effect such cases have on social cohesion. When a leading politician is publicly perceived as wealthy and well-connected, yet repeatedly embroiled in controversies that suggest self-enrichment or preferential treatment, the distance between the political class and the general population widens. Neither the unresolved questions surrounding the procurement of masks, nor the connections to the Thiel network, nor the controversy surrounding surrogacy have prompted him to reconsider his position as parliamentary group leader or to publicly demonstrate any reflection. This unwavering composure can be interpreted as a strategic calculation based on the experience that waves of media outrage generally subside without leaving any institutional scars. This very experience likely forms the basis for Spahn's self-assured, almost unmoved demeanor in every new controversy. Where previous generations of politicians at least maintained the appearance of accountability in comparable cases of suspicion, here we see a style of politics that treats public criticism primarily as a communicative problem that can be solved by simply waiting it out, rather than as a substantive challenge that demands a response.

A litmus test for the CDU's capacity for renewal

For the CDU as a people's party, this raises a fundamental question about its own capacity for renewal. A party that adopts fundamental ethical positions by a clear majority at its party conferences, while its most prominent representative in the Bundestag effectively undermines these positions through his personal conduct without facing internal criticism, risks devaluing its programmatic substance. When resolutions become mere lip service as soon as they affect its own leadership circle, the party loses predictability for its electorate and moral authority in public debates.
