Solar obligation: Photovoltaic requirement or coercion for Schleswig-Holstein?

Following the state elections in Schleswig-Holstein on May 8, 2022, the CDU and the Greens agreed on a coalition agreement. They pledged to make Schleswig-Holstein climate-neutral by 2040. To achieve this, the state building code will be revised accordingly. Solar panels are to be mandatory in Schleswig-Holstein by 2025.

What has happened so far

The obligation to use solar energy is not new. If it were up to the then Schleswig-Holstein Environment Minister Jan Philipp Albrecht, it would have been implemented "sooner rather than later"

“With this new law, we are continuing to write the script for the energy transition and climate protection in Schleswig-Holstein. The law will make a crucial contribution to ensuring that our state has a sustainable ecological and economic future,” said Environment Minister Albrecht at a cabinet meeting on February 16, 2021.

The amendment includes several measures to expand photovoltaics. For example, newly constructed parking lots with more than 100 spaces will be required to have roofs with integrated photovoltaic systems. Photovoltaic systems will also be standard practice for new construction and roof renovations of non-residential buildings. The expansion of ground-mounted photovoltaic systems will also be promoted within the framework of the state development plan. At the federal level, the state government will advocate for pilot PV projects in conjunction with noise and visual barriers along federal highways and roads, as well as for rest areas and parking lots to be equipped with charging stations and PV systems.

Similar to the approach taken in Baden-Württemberg . Exact details and the exact schedule are not yet known. The project is expected to begin in early 2022.

What are non-residential buildings?

Non-residential buildings comprise a multitude of enclosed spaces where more than half of the total usable floor area is used for non-residential purposes. Usable floor area is defined in DIN 277. This standard is used to determine the floor area and volume of buildings or parts of buildings in structural engineering. The area calculation according to this standard is, among other things, the basis for calculating building permit fees, which is why an area calculation according to DIN 277 exists for almost every building.

Conversely, residential buildings are buildings that, according to their intended purpose, are predominantly used for residential purposes, including residential homes, retirement and nursing homes, and similar facilities.

Non-residential buildings are:

Administrative and office building
Factory halls, workshops, warehouses, also logistics centers, commercial buildings or similar
Parking garages
Hotels, restaurants, cinemas, etc.
School and university buildings, museums, theaters, sports halls, etc.
Buildings for energy, waste and water management
Agricultural buildings
Institutional buildings such as hospitals, nursing homes, prisons, etc.
